These Terms of Service ("Terms") govern your access to and use of the HVX Voice platform. By using the service, you agree to these Terms.
1. Service Description
HVX Voice provides an AI-powered phone receptionist designed for HVAC businesses. The service answers inbound calls, captures caller information, schedules service appointments, and sends transactional notifications such as appointment confirmations.
2. Accounts and Responsibilities
You are responsible for maintaining accurate account information and for all activity that occurs under your account. You represent that you are authorized to use any phone numbers, calendars, and data connected to the service.
3. SMS and Call Compliance
HVX Voice sends transactional messages only, including appointment confirmations and service-related notifications.
You are solely responsible for:
- Determining whether call monitoring is permitted
- Providing any required disclosures to callers
- Obtaining all legally required consent under applicable laws, including TCPA and state regulations
HVX Voice does not provide legal advice and does not determine whether consent is required for your specific use case.
4. AI Disclaimer
The service uses automated and AI-powered systems. AI-generated outputs may be inaccurate or incomplete. You remain responsible for verifying appointments, customer information, and business decisions.
5. Subscriptions and Billing
Paid plans are billed in advance on a recurring basis through Stripe. Fees are non-refundable except where required by law. We may modify pricing with reasonable notice.
6. Acceptable Use
You agree not to misuse the service, violate applicable laws, infringe rights, or attempt to disrupt, reverse engineer, or abuse the platform.
7. Availability and No Warranty
The service is provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted or error-free operation.
8. Suspension and Termination
We may suspend or terminate access if your use of the service creates legal, regulatory, carrier, or reputational risk. You may cancel your subscription at any time.
9. Limitation of Liability
To the maximum extent permitted by law, HVX Voice is not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim is limited to the amount you paid for the service in the twelve (12) months preceding the event giving rise to the claim.
10. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
